1. Acceptance of Terms

By accessing or using the Finark platform and services, you agree to comply with and be bound by these Terms of Service ("Agreement"), as well as any additional guidelines, rules, or restrictions placed on specific features or services of Finark. If you do not agree to these terms, you should not access or use the services provided by Finark.


2. Overview of Finark Solutions

At Finark, our suite of APIs empowers investment professionals and fintechs to streamline complex portfolio analysis and elevate client engagement.

a. Finark Acquire — Real-Time, Client-Centric Portfolio
Finark provides secure APIs that allow wealth managers and fintech platforms to access consolidated investment data directly from a client's Common Account Statement (CAS), using validated identifiers such as PAN and mobile number.

Retrieve details of mutual fund holdings, transaction history, and other investment records in a structured and developer-friendly format.

Enables seamless integration of verified client data into your own tools and dashboards—without manual effort or third-party aggregation tools.

b. Finark Connect — Privacy-First Portfolio Comparison
Finark Connect provides access to a broad set of APIs delivering data on mutual funds, NAVs, holdings, indices, NFOs, and much more.

A privacy-first solution for integrating investment data into advisory platforms—no client credentials required.

Enables quick, data-rich portfolio comparisons and market analysis with reliable and timely updates.

Both solutions are designed to streamline the sales journey, enhance client engagement, and strengthen portfolio performance conversations—making investment advice more personalized, data-driven, and scalable.


3. API Access and Security

Access to Finark's APIs is granted upon successful onboarding and issuance of an API key. You are responsible for safeguarding your API key and ensuring it is not shared or misused. All activities performed using your API key will be considered your responsibility. Please notify Finark immediately if you suspect any unauthorized use or compromise of your API key.

6. Intellectual Property

All intellectual property rights in the Finark APIs, including the code, design, and documentation, belong to Finark. You do not acquire any rights, title, or interest in Finark's intellectual property by using the services, and any use of Finark's intellectual property must be in accordance with these Terms.


7. Changes to Terms

Finark may update, modify, or discontinue features of its API services at any time, with or without prior notice. Additionally, Finark reserves the right to revise the Terms of Service and Service Level Agreement (SLA) at its sole discretion. Unless explicitly stated otherwise, any updates will take effect upon publication. For the latest version, please refer to www.finark.com.


8. Service Availability and SLA

Finark is committed to maintaining a reliable and efficient service. While we strive for high availability and prompt support, specific details including uptime expectations, maintenance schedules, and support response times are outlined in our Service Level Agreement (SLA) . Your continued use of the API indicates acceptance of these service terms.


9. Data Accuracy

Finark strives to provide accurate and reliable data through its APIs. However, due to the nature of data aggregation and external sources, we cannot guarantee that all data will be error-free, complete, or up-to-date.

Users are encouraged to verify critical data independently before relying on it for decision-making. Finark is not liable for any loss or damages arising from the use of the data.


10. Service Description

Finark provides a robust API solution that delivers access to critical financial data, such as mutual fund details, NAVs, indices, and holdings. These APIs are designed for seamless integration with third-party platforms, enabling users to enhance their investment strategies and portfolio analysis with real-time and historical data.


11. Subscription and Billing

If you subscribe to any paid services on Finark, you will be billed according to the subscription plan you selected at the time of registration. Subscription fees are non-refundable except as expressly provided in these Terms. Finark may change the pricing for its services at any time.


12. Automatic Renewal

Your API subscription will automatically renew annually, starting from the day of commencement. You will receive a renewal reminder 15 days before your plan expires, with an updated subscription rate reflecting a 20% increase.

Your plan will renew on the same terms unless otherwise notified. Any changes to the subscription fees will be communicated in advance of the renewal date. To avoid interruptions in service, please ensure that the renewal is processed before the plan expires.


13. Changes to the Service

Finark reserves the right to change, modify, or discontinue any part of the platform or services at any time, including but not limited to adding, removing, or altering features. This may include adjustments to the API functionality, data sources, or other service-related components.

Additionally, Finark reserves the right to implement a 20% annual increase in pricing on the pre-negotiated terms during the renewal cycle. If any changes to services or pricing occur, they will be communicated in advance. In the event of a discontinuation of services, Finark will provide a pro-rata refund based on the unused portion of the subscription.

If you are dissatisfied with any such changes, or with the performance or availability of the services, your sole remedy is to cancel your subscription as outlined below.

You may choose to terminate your Finark account at any time by contacting our support team.

Finark reserves the right to suspend or terminate your access to the services without prior notice if any of the following occurs:

In the event of termination, your right to use the services will cease immediately, and you may lose access to any data or content associated with your account.


15. Disclaimers and Warranties

The services, including the Finark APIs, data, and related content, are provided on an "as-is" and "as-available" basis. Finark makes no warranties or representations, express or implied, regarding the accuracy, reliability, timeliness, completeness, or suitability of the services for any particular purpose.

Finark expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data.

No advice or information obtained by you from Finark or through the services shall create any warranty not expressly stated in these Terms.


16. Limitations of Liability

Finark, including its officers, directors, employees, agents, affiliates, and licensors, shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, resulting from:
(a) the use or the inability to use the services;
(b) unauthorized access to or alteration of your data or transmissions;
(c) statements or conduct of any third party on the services; or
(d) any other matter relating to the services.

You understand and agree that your use of the services is at your sole risk. All services are provided on an "as-is" and "as-available" basis.


17. Privacy and Data Protection

Finark is committed to protecting user data in accordance with applicable laws and the terms outlined in this Terms of Service and SLA. All data interactions via our APIs are governed by these agreements to ensure transparency, security, and responsible use.


18. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of India. You agree that the jurisdiction for any matters arising under or related to this Agreement shall be in Mumbai, Maharashtra, India.


19. Waiver of Class Action

Except as prohibited by law, you agree that all disputes will be adjudicated individually and not in a class, mass, or representative action.


20. Indemnification

You agree to indemnify and hold Finark harmless from any claims, damages, liabilities, or costs arising out of your use of the platform or violation of these Terms.


21. User Responsibilities

You agree to use the platform only for lawful purposes and in a manner that does not infringe on the rights of others. You are responsible for all actions performed through your account.


22. Subscription and Payment Terms

If you subscribe to a paid service on Finark, you will be billed in accordance with the subscription terms selected. You agree to pay all applicable fees, including any taxes, and to keep your payment information up to date.


23. Entire Agreement

These Terms of Service, along with the Privacy Policy and any other legal notices or agreements published by Finark on the Service, constitute the entire agreement between you and Finark (HUEX PVT. LTD) with respect to the Service. They supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Finark regarding the Service.

27. Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms of Service will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the intent of the original provision. .
